South Burlington Resident Threatens Lawsuit Over Szymanski Park Pickleball Noise—Will the City Act?

Szymanski Park Pickleball Noise Dispute: Jovana Guarino, a resident of South Burlington, Vermont, says the noise from pickleball games at Szymanski Park has become unbearable. After three years of complaints, she is now considering legal action against the city if no steps are taken by this fall to ease her concerns.

Guarino lives near the park and wants the pickleball courts moved to Veterans Memorial Park on Dorsett Street. She says the constant sound of play has affected her quality of life and is calling for immediate action from city leaders.

Longtime Noise Complaints

Guarino has raised her concerns with the city multiple times over the past three years. She believes the city should help find a temporary solution while planning a permanent move for the courts.

“I will if the city doesn’t come to me and say, we have plans for pickleball someplace else. ‘How can we relieve some of your issues right now until then?’” (Jovana Guarino).

She has collected about 100 signatures from neighbors who support her efforts. Since September, she says about 25 more people have signed the petition, which she plans to present to the South Burlington City Council in the fall.

City’s Response and Survey Findings

South Burlington City Councilor Andrew Chalnick said he walked around Szymanski Park and talked to nearby residents. While some agreed with Guarino, many others did not find the noise to be a major problem.

“The folks in this unscientific survey, most of those folks did not think the noise was a concern. I don’t dismiss that from her perspective, it is a concern. But it is a public park,” (Andrew Chalnick).

In July 2024, the city looked into concerns about speeding and traffic on Andrews Avenue, the road leading to the park. The study showed that drivers were following the 25-mile-per-hour speed limit.

Next Steps and Possible Lawsuit

Guarino has decided to wait through the summer. However, if her concerns about noise, traffic, and safety are not addressed by the fall, she plans to take legal action.

“I’ll stick out the noise this summer and if nothing happens by the fall, I plan to sue the city,” (Jovana Guarino).

Her petition and possible lawsuit could influence how the city manages park use and handles growing public interest in pickleball.
